By accessing or using Beakle (“the Service”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including business owners and their customers who interact through Beakle-powered WhatsApp numbers.
2. Description of Service
Beakle provides an AI-powered WhatsApp automation platform that connects to your WhatsApp number, processes incoming messages using artificial intelligence, and sends automated replies based on your business knowledge base. The Service also includes message logging, contact management, escalation notifications, and analytics.
3. Account Responsibilities
- You must provide accurate and complete information when creating your account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years old to use the Service.
- You may only connect WhatsApp numbers that you own or have authorization to use.
4. Acceptable Use
You agree not to use Beakle to:
- Send spam, unsolicited messages, or bulk marketing without consent
- Harass, threaten, or abuse any person
- Distribute illegal, harmful, or fraudulent content
- Impersonate another person or entity
- Violate WhatsApp’s Terms of Service or any applicable laws
- Attempt to reverse-engineer, hack, or disrupt the Service
- Use the Service for any purpose that could harm minors
5. AI-Generated Content
Beakle uses AI to generate replies to your customers. While we strive for accuracy, AI responses may occasionally be incorrect or inappropriate. You are ultimately responsible for the messages sent through your WhatsApp number. We recommend reviewing AI interactions regularly and maintaining an up-to-date knowledge base.
6. Billing and Payments
- Paid plans are billed monthly unless otherwise stated.
- Prices are displayed in Nigerian Naira (NGN).
- You may cancel your subscription at any time. Access continues until the end of the billing period.
- We reserve the right to change pricing with 30 days’ notice.
- Discount codes are subject to their specific terms and may have usage limits or expiration dates.
7. Service Availability
We aim to maintain 99.9% uptime but do not guarantee uninterrupted service. WhatsApp connectivity depends on WhatsApp’s own infrastructure, which is outside our control. We may perform scheduled maintenance with advance notice.
8. Intellectual Property
Beakle and its original content, features, and functionality are owned by Beakle and are protected by intellectual property laws. Your business data and knowledge base content remain your property. You grant us a license to use this content solely to provide the Service.
9. Limitation of Liability
To the maximum extent permitted by law, Beakle shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
We may suspend or terminate your account if you violate these terms, engage in abusive behavior, or fail to pay for your subscription. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data as described in our Data Deletion policy.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
